Please read these terms carefully before using ResumePa services. By using our services, you agree to be bound by these terms.

1. Introduction and Acceptance of Terms

Welcome to ResumePa, a Software-as-a-Service platform providing AI-generated career tools. These Terms of Service ("Terms") govern your access to and use of ResumePa's website and services ("Services"). By creating an account or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use ResumePa.

We also encourage you to review our Privacy Policy, which is incorporated by reference, to understand how we collect and use your information.

We reserve the right to update or modify these Terms at any time to reflect changes in our Services or for legal reasons. Any changes will be effective upon posting. We will notify users of material updates (for example, via email or a notice on our site). Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Services.

2. Services Provided

ResumePa provides AI-powered assistance for job seekers, including: resume generation, cover letter drafting, and interview simulation tools. Our AI generates content based on the information you provide and general best practices.

Please note that AI-generated content may not be perfect – while we strive for quality, ResumePa is not responsible for inaccuracies in the content, and the Service should not be relied on as the sole basis for critical decisions. For example, our suggestions might occasionally contain errors, outdated information, or recommendations that do not precisely fit your personal situation.

You should review and edit all AI-generated resumes or letters before using them in any official capacity. The AI features are intended to assist and enhance your job search, not to replace your own judgment or professional advice. You are responsible for verifying that the content is accurate and appropriate for your needs.

We do not guarantee that using our generated resumes or letters will result in a job offer or interview – the Service is a tool to help you present your qualifications, but ultimate success depends on many factors outside our control. Similarly, the interview simulation is for practice purposes and does not assure any specific performance outcome. By using ResumePa, you agree that any reliance on AI-generated content is at your own risk and discretion.

Ownership of Content: You retain ownership of the information and materials you provide to the Service (your profile data, job history, etc.), as well as the content generated specifically for you by our AI (such as the text of your resume or cover letter). As between you and ResumePa, the output generated for you is considered your content, and we make no claim of copyright over it.

You are free to use, modify, or share your generated resume and letters for your personal job-seeking activities. By using the Service, you grant ResumePa a license to use your input data and generated content as needed to operate and improve the Services (for example, to train our algorithms or provide customer support), in accordance with our Privacy Policy. We implement measures to avoid producing plagiarized or infringing content; however, you should not use the Services to create any content that violates someone else's rights or to engage in any unlawful copying.

3. User Accounts and Access

Account Registration: To access most features of ResumePa, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep it updated. This includes your name, a valid email address, payment information (for paid plans), and any profile details used for generating your documents. Providing false information or impersonating another person is a violation of these Terms. ResumePa may suspend or terminate your account if any information provided is found to be inaccurate or misleading.

Account Eligibility: You must be at least 18 years old to create an account and use ResumePa's Services. If you are under 18, you may use the Services only with involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf (in jurisdictions where such arrangement is legally permissible). By accepting these Terms, you represent that you meet the eligibility requirements.

Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Account sharing is strictly prohibited – your login is meant for your personal use only. Do not share your password or allow others to use your account. You agree to notify ResumePa immediately at our contact email if you suspect any unauthorized access to or use of your account. ResumePa will not be liable for any loss or damage arising from your failure to secure your account. We recommend using a strong, unique password and updating it periodically to protect your account.

4. Payment and Refund Policy

Pricing and Payment: Some ResumePa Services are offered for a fee (e.g., subscription plans for premium features). All fees are clearly listed on our website or application. By signing up for a paid plan, you agree to pay the specified subscription fees and any applicable taxes. Billing cycles (e.g., monthly or annual) and payment methods will be as agreed at the time of purchase. Charges will be billed in advance at the start of each subscription period. You authorize ResumePa (or our payment processor) to charge your provided payment method for the recurring subscription fee, until you cancel. It's important that our payment terms and refund process are clearly understood to avoid disputes. If we are unable to process payment (e.g., due to an expired credit card), we will notify you and may suspend your access until payment is received.

Refund Policy: We want you to be satisfied with our Service while also preventing abuse of our refund system. Refund eligibility and conditions are as follows:

- Refund Request Window: You may request a refund within a short window after purchase. Specifically, if you are not satisfied, you must contact us within the first 7 days from the initial purchase date to be eligible for a refund. This limited refund window is intended to mitigate the risk of abuse or fraudulent claims. Requests made beyond this period will ordinarily not be honored, except as required by law or at our sole discretion.

- Eligibility Criteria: Refunds are designed to cover situations where the Service did not meet your expectations due to issues on our end (for instance, serious technical problems or the Service not functioning as advertised). We may ask for a brief explanation of the issue, and in some cases may require reasonable proof of the problem (e.g., screenshots of an error) if a technical fault is cited. We reserve the right to decline refund requests if we find that the Service was substantially used and delivered as promised. Minor dissatisfaction (such as personal preference on writing style) may not qualify, but we will review each request in good faith.

- One Refund per Customer: Each user is entitled to only one refund under this policy. This means if you have previously received a refund from ResumePa, we typically will not grant a second refund for any subsequent re-subscription or purchase. This limitation is in place to prevent abuse (for example, repeatedly using the Service and then asking for refunds). Choosing to subscribe again after receiving a refund is at your own risk, and that purchase will be considered final.

- Subscription Cancellations and Partial Refunds: If you cancel an ongoing subscription, you will retain access to premium features until the end of your paid term (unless we grant a refund). For annual subscriptions or multi-month plans canceled early, ResumePa may, at our discretion, offer a pro-rated refund for the unused portion of the subscription term. For example, if you paid for a year and decide to cancel halfway through, we might refund the remaining unused months. This practice of refunding the unused portion is not guaranteed, but we aim to be fair; we may choose to do so especially in cases of hardship or if the service is not used for the remainder of the term. Monthly subscriptions are generally not prorated (you will have access until the end of the current month and the subscription will not renew the next month).

- How to Request a Refund: To request a refund, you must contact our customer support (see Contact Information below) within the eligible timeframe. Include the email associated with your account and explain the reason for your request. If approved, refunds will be issued to the original payment method. Please allow a reasonable time for processing (typically 5–10 business days).

Please note that we reserve the right to refuse a refund in cases of suspected fraud, violation of these Terms, or excessive/refund abuse patterns, even if the request is within the stated time. Except for the refund rights outlined above, all purchases are final. Nothing in this policy affects any rights you may have under applicable consumer laws; any statutory rights to refunds or cancellation are in addition to this policy.

5. Permitted and Prohibited Uses

Permitted Use: ResumePa is provided for your personal and lawful use in preparing job application materials and practicing interview skills. We grant you a limited, non-exclusive, non-transferable license to use our Services for these purposes. You agree to use the Service only as intended and in compliance with these Terms and all applicable laws and regulations.

Prohibited Uses: To maintain a fair and safe service, you agree NOT to engage in any of the following activities:

- Illegal or Harmful Activities: Using ResumePa for any unlawful purposes or to promote illegal activities is strictly prohibited. You must not use the Service to create content that is defamatory, fraudulent, obscene, infringing on others' rights, or that violates any law or regulation. Additionally, you may not use the Service to harass, threaten, or cause harm to anyone, or to collect personal data about others without consent.

- Unauthorized Access and Interference: You shall not attempt to interfere with the normal operation of ResumePa or circumvent any access controls. This includes not introducing viruses or malicious code, not engaging in any activity that disrupts or overloads the Service (e.g. denial-of-service attacks, spamming the AI with automated requests), and not using any robot, scraper, or automated means to access the Service in violation of our technical restrictions. Any attempt to probe, scan, or test the vulnerability of our systems or to breach security or authentication measures is prohibited.

- Account Misuse: Sharing your account or allowing multiple people to use a single account is not allowed. Each user must maintain their own credentials. You also may not create multiple accounts for the same person or create an account for someone else without authorization. Any form of account abuse, including using someone else's account or providing false identity information, can result in termination.

- Intellectual Property Violations: You must not misuse ResumePa's intellectual property or the content provided through the Service. Do not reverse engineer, decompile, or otherwise attempt to extract the source code of any part of the Service. You may not reproduce, distribute, or create derivative works from our software or content unless expressly permitted. Similarly, unauthorized use or copying of ResumePa's content, trademarks, or materials is prohibited. This means you cannot take the resumes or letters generated for others or any portion of our website/app content and republish or resell it. All rights in the Service and its components are reserved by ResumePa and its licensors.

- Misuse of AI Outputs: You agree not to use the AI-generated content in a manner that violates these Terms or applicable law. For example, you should not present AI output as factual if it's not verified, and you should not use it to deceive employers (e.g., do not input false credentials to generate a resume). The AI should not be used to generate content for illicit purposes or to disseminate misinformation. Any misuse of AI-generated content that results in legal claims or harm will be your responsibility and could lead to account termination.

- Other Unacceptable Behavior: Any other behavior that violates the letter or spirit of these Terms is prohibited. This includes attempting to exploit the Service in ways it is not intended, using the Service to compete with ResumePa (such as training a rival AI with our outputs without permission), or any conduct that we determine, in our discretion, to be abuse of the Service or detrimental to us or other users. We reserve the right to define and determine what constitutes abuse or excessive use (for instance, unusually high generation of content that suggests non-personal or commercial use may be flagged as misuse of a service meant for individual job-seekers).

ResumePa reserves the right to monitor usage to enforce these guidelines. If we discover behavior that we believe violates these rules or any other provision of these Terms, we may suspend or terminate your account immediately and without notice. Serious violations (such as illegal activity) may be reported to law enforcement. We appreciate your cooperation in keeping our community safe and respectful.

6. Disclaimer of Warranties

ResumePa is committed to providing a helpful service, but there are some important warranty disclaimers you need to understand. Your use of the Service is at your sole risk. The Services are provided on an "as is" and "as available" basis. ResumePa disclaims all warranties of any kind, whether express, implied, or statutory, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no guarantees or warranties that: (a) the Services will meet your specific requirements or expectations; (b) the Services will be uninterrupted, timely, secure, or error-free; or (c) the results obtained from the use of the Services will be accurate or reliable.

No Professional Advice: While ResumePa provides content related to job applications and interview technique, we are not a professional career advisory or legal service. Any information or AI-generated advice you receive through our platform (such as resume suggestions or interview answers) is for informational purposes and should be used with your own discretion. We do not warrant that any resume or cover letter generated will guarantee you a job, or that the interview answers will guarantee success – those outcomes depend on factors beyond our Service. You assume all responsibility for how you use the information provided.

AI Outputs: We strive to ensure the AI-generated content is useful and relevant, but given the nature of AI, we do not warrant that the content will be free of errors or omissions. ResumePa is not liable for any inaccuracies or biases that may arise from AI-generated content. We do not guarantee that the AI's suggestions will be suitable for your unique situation. Users should apply their own judgment and are responsible for verifying the content's accuracy and appropriateness as noted above. We also disclaim any warranty that the AI content will be unique; although we aim for originality, any similarity to other content is coincidental and not guaranteed to be plagiarism-free.

To the extent that our website or communications might reference success stories or expected outcomes, such examples are not guarantees. No information or advice obtained from ResumePa (whether written or oral) shall create any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not fully apply to you. In such cases, the warranties are disclaimed to the fullest extent permitted by applicable law.

7. Limitation of Liability

Limit on Types of Damages: To the fullest extent permitted by law, ResumePa and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, damages for lost profits, lost opportunities, business interruption, loss of data, or other intangible losses arising out of or related to your use of (or inability to use) the Services. These limitations apply to any theory of liability, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

For example, ResumePa will not be liable if an employer rejects your application or if any content generated by our AI allegedly causes you to miss an opportunity. We are also not liable for damages resulting from: (i) your use of or reliance on the Services or any content obtained through the Services; (ii) unauthorized access to or alteration of your transmissions or data; or (iii) statements or conduct of any third party on the Service (such as links to external sites or third-party content).

Additionally, if you download any material from our site, you do so at your own discretion and risk, and you will be responsible for any damage to your computer system or loss of data that results.

Cap on Liability: In no event shall the aggregate liability of ResumePa (and its affiliates and agents) to you for all claims arising out of or related to the Services or these Terms exceed the total amount of fees you have paid to ResumePa for the Service in the 12 months preceding the claim. If you have not paid any fees (for example, using a free version), ResumePa's liability to you shall not exceed a nominal amount (e.g., $50 or equivalent local currency). This limitation of liability is a fundamental element of the agreement between you and us – the Service would not be provided to you without such limitations.

Exceptions: Some jurisdictions do not allow the exclusion or limitation of liability for certain damages. If laws applicable to you prohibit the above limitations, then to the extent that a court or arbitrator determines that such prohibitions apply, some of these limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law. Nothing in these Terms is intended to limit or exclude liability that cannot be limited by law (for example, certain statutory liabilities or liability for intentional misconduct).

You acknowledge that ResumePa is a relatively low-cost service, and the allocation of risk in these Terms (reflecting a limitation of liability and warranty disclaimer) is part of the bargain between you and us. You agree that these limitations of liability are reasonable given the nature of the Services. If you do not agree, please do not use the Service.

8. Modifications and Termination

Modification of Services: ResumePa reserves the right to modify, update, or discontinue the Services (or any part of the Services) at any time. We are constantly improving our platform, so we may add or remove features, change algorithms, or make other changes. We will try to inform users of major changes (for example, significant feature removal or a change in pricing), but there may be instances where we make changes without prior notice. ResumePa shall not be liable to you or any third party for any modification, price change, suspension, or discontinuation of the Services. If a change or discontinuation of the Service materially affects your paid subscription, please contact us – in some cases (for instance, if we discontinue the service entirely), we may provide a refund for the unused portion of your subscription as a courtesy.

Modification of Terms: As noted in the Introduction, we may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top (if provided) and, for significant changes, attempt to notify you (via email or through the Service). It is your responsibility to review any revised Terms. If you continue to use ResumePa after changes to the Terms take effect, you are indicating your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and, if applicable, cancel any subscription.

Termination by ResumePa: We hope to have you as a user for a long time, but ResumePa reserves the right to suspend or terminate your access to the Services at our sole discretion under certain circumstances. This includes, but is not limited to: (a) breach of these Terms or other policies (e.g., misuse of the Service or failure to pay fees); (b) behavior that is illegal, abusive, or that may harm ResumePa's reputation or systems; (c) unexpected technical or security issues; or (d) if we cease offering the Services.

We may, in such cases, terminate or suspend your account immediately, without notice. In most cases, we will attempt to notify you of the reason for termination or suspension, either prior to or after taking action, via the email on your account. If the issue can be resolved (for example, an overdue payment), we may give you an opportunity to fix it and have your access reinstated, but we are not obligated to do so.

ResumePa also reserves the right to terminate this agreement and your account at any time for any reason (even without cause) by providing notice to you (for instance, sending an email to the address associated with your account). If we terminate your account without cause, we will refund any prepaid, unused subscription fees as of the termination date. However, if termination is due to your violation of these Terms or misconduct, you will not be entitled to any refund for payments already made, and we may bar you from signing up again.

Termination by You: You are free to stop using ResumePa at any time. You may delete your account or cancel your subscription through your account settings or by contacting our support. If you cancel a paid subscription, the cancellation will take effect at the end of your current billing period unless otherwise stated – you will not be charged further, but we do not typically provide refunds for the remaining period except as stated in our refund policy above. It is your responsibility to save any content (like resumes or letters) you wish to keep prior to terminating your account. After termination, we may delete your account data in accordance with our data retention policies and Privacy Policy, and you will no longer have access to the Services or your stored content.

Effect of Termination: Upon any termination of your account or this agreement, all licenses and rights granted to you in these Terms will immediately cease. You must stop using the Services and (if applicable) uninstall any ResumePa software. Sections of these Terms that by their nature should survive termination (such as intellectual property provisions, Disclaimer of Warranties, Limitation of Liability, Dispute Resolution, and others) will continue to apply even after termination. Termination of your access or account shall not relieve you of any obligations that arose prior to the date of termination (for example, paying any outstanding fees or complying with confidentiality and intellectual property protections).

9. Governing Law and Dispute Resolution

Governing Law: This Agreement and any dispute arising out of or related to these Terms or the Services will be governed by and construed in accordance with the laws of England and Wales (or the laws of your country/region if mandated by applicable law), without regard to its conflict of law principles. If you reside outside of the United Kingdom, you may also have certain consumer protection rights under the laws of your country of residence, which shall apply in addition to these terms to the extent not waived or conflicted. For Business (non-consumer) users, or where permissible, the law of the above jurisdiction will be exclusive.

Jurisdiction: You agree that, subject to the dispute resolution provisions below, any dispute that proceeds to court (in cases where arbitration is not required or is unenforceable) shall be brought in the courts of competent jurisdiction located in England. Both you and ResumePa consent to the personal jurisdiction of such courts. If you are a consumer resident outside England, you may additionally file claims in your local courts if a mandatory law provides for that. However, we each agree not to pursue legal action in any jurisdiction that is not permitted by this section or by mandatory local laws.

Initial Dispute Resolution: We believe most disagreements can be resolved informally. You agree to contact ResumePa first to attempt to resolve any dispute or claim related to the Services or these Terms by good-faith discussion. You can reach us via the Contact Information provided below. Both you and ResumePa agree to use best efforts to settle any dispute directly through consultation and negotiations, before initiating formal proceedings. If we are unable to resolve the issue informally within 30 days of notification (or another mutually agreed timeframe), the below steps will apply.

Arbitration Agreement: To the extent permitted by law, you and ResumePa agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services that cannot be resolved informally will be finally resolved by binding arbitration. By agreeing to arbitration, we each are giving up the right to have our dispute decided in court by a judge or jury, and we are giving up the ability to pursue or participate in a class or representative action.

Instead, our dispute will be resolved by a neutral arbitrator whose decision will be final, except for a limited right of appeal under the U.K. Arbitration Act 1996 (if applicable) or similar laws. The arbitration shall be administered by an established arbitration body. If you reside in the United Kingdom or another country, the arbitration may be administered by the London Court of International Arbitration (LCIA) or a similar institution, under its rules, or by another reputable service we mutually agree on. If you reside in the United States, arbitration will be administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. Arbitration procedures are typically more streamlined and limited than court procedures, but an arbitrator can award the same damages and relief that a court can on an individual basis. Each party will bear its own attorneys' fees and costs unless the arbitrator rules otherwise or an applicable law provides for shifting of fees.

Class Action Waiver: You and ResumePa agree that any arbitration (or, if arbitration is unenforceable, any court action) will be conducted on an individual basis only, and not in a class, collective, or representative action. This means you may not join your claim with those of any other person or entity, and you may not assert a claim in a representative capacity on behalf of anyone else in any lawsuit or arbitration. The arbitrator may not consolidate the claims of multiple parties. If this class action waiver is found to be unenforceable, then the entirety of this Arbitration Agreement shall be null and void, and the dispute must be brought in court (not as a class action) in the jurisdiction specified above.

Opt-Out: If you are a new user of ResumePa, you may opt out of the arbitration agreement and class waiver provision by sending written notice to our Contact Information address within 30 days of first accepting these Terms, stating that you decline arbitration. However, if you opt out, you agree that disputes will be resolved by the courts in the jurisdiction specified above.

Exceptions: Notwithstanding the foregoing arbitration clause, either party may bring a claim for injunctive relief or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or to prevent unauthorized use of the Services (for example, you may file a claim in court if you believe your personal data is being misused in violation of the law, and we may go to court to stop someone from misusing our trademarks or hacking our service). Additionally, disputes that are not subject to arbitration by law (such as certain statutory consumer rights in some jurisdictions) are not covered by the above arbitration agreement.
